Fertilizer business conditions from 2027 bring important changes, especially for dealers already in operation and those preparing to open a fertilizer store. Cutting and repealing the conditions for fertilizer trading simplifies the legal requirements, but there are still points to note in order to do business in compliance with the law.

Under Law No. 21/2026/QH16, Article 42 of the Law on Crop Production on conditions for fertilizer trading is repealed from January 1, 2027. Before that, Resolution No. 66.19/2026/NQ-CP provided that these conditions would no longer be applied from July 1, 2026. So how do these changes affect the fertilizer business? Viet Nga Fertilizer summarizes the regulations and practical notes for our dealers, for people preparing to open a dealership and for agricultural supply stores.

1. How do fertilizer business conditions change from 2027?

The most notable change for dealers, stores, organizations and individuals trading in fertilizer is the repeal of Article 42 of the Law on Crop Production on conditions for fertilizer trading. Under Law No. 21/2026/QH16, this provision is repealed from January 1, 2027, when the Law takes effect.

Accordingly, the fertilizer trading conditions set out in Article 42 of the Law on Crop Production no longer apply. This is part of the policy of cutting and simplifying business conditions in the agriculture and environment sector.

However, the repeal of Article 42 does not mean that the fertilizer business is exempt from other legal obligations. Dealers must still comply with regulations on product quality, origin and goods labelling. The conditions for fertilizer production are also not within the scope of the repeal of Article 42.

2. When are the conditions for fertilizer trading officially repealed?

Although Law No. 21/2026/QH16 takes effect from January 1, 2027, the non-application of the fertilizer trading conditions in Article 42 of the Law on Crop Production had already been set earlier under Government Resolution No. 66.19/2026/NQ-CP.

Specifically, Resolution No. 66.19/2026/NQ-CP was issued on May 18, 2026, providing that the fertilizer trading conditions in Article 42 of the Law on Crop Production would not be applied from July 1, 2026.

Subsequently, Law No. 21/2026/QH16 was passed by the National Assembly on August 24, 2026, repealing Article 42 of the Law on Crop Production, with effect from January 1, 2027.

Dealers and traders therefore need to distinguish two milestones:

  • From July 1, 2026: The fertilizer trading conditions in Article 42 are not applied, under Resolution No. 66.19/2026/NQ-CP.
  • From January 1, 2027: Law No. 21/2026/QH16 takes effect and Article 42 of the Law on Crop Production is officially repealed.

Distinguishing these two milestones helps dealers understand exactly when the rules apply, and avoid the mistaken belief that the fertilizer trading conditions will only be cut in 2027.

3. Is a Certificate of Eligibility for Fertilizer Trading still required?

Under the new rules, the fertilizer trading conditions in Article 42 of the Law on Crop Production are repealed from January 1, 2027 under Law No. 21/2026/QH16. Before that, Resolution No. 66.19/2026/NQ-CP provided that these conditions would not be applied from July 1, 2026.

However, the repeal of the fertilizer trading conditions should be distinguished from the regulations on the procedure for granting the Certificate of Eligibility for Fertilizer Trading. To determine exactly what is required regarding the Certificate at each point in time, organizations and individuals in the business should rely on the laws and administrative procedures currently in force.

In addition, cutting the fertilizer trading conditions does not replace business registration procedures or exempt traders from other legal obligations related to their business and goods.

4. Fertilizer trading conditions removed – what should existing dealers do?

For dealers already in operation, the repeal of the fertilizer trading conditions in Article 42 of the Law on Crop Production does not change their responsibility to comply with other laws in the course of business. Dealers should therefore continue to focus on managing their goods and keeping up to date with relevant regulations.

4.1. Keep controlling the origin and quality of the fertilizers you sell

Although the fertilizer trading conditions in Article 42 are no longer applied, legal requirements on product quality, origin and goods labelling must still be met under current regulations.

Therefore, when buying in and selling fertilizer, dealers should give priority to products with a clear origin, complete product information and compliance with quality and market circulation regulations. Choosing a reliable manufacturer or distributor also helps limit risks with goods, protect customers' interests and maintain the dealer's business reputation.

4.2. Follow new regulations and guidance

Besides controlling their sources of supply, dealers should regularly keep up with legal documents and guidance from state management agencies related to the fertilizer business.

Establishments that both trade in and produce fertilizer need to clearly distinguish the rules that apply to each activity in order to fulfil the relevant legal obligations correctly.

5. What should people opening a fertilizer dealership from 2027 keep in mind?

Repealing the fertilizer trading conditions in Article 42 of the Law on Crop Production helps simplify the legal requirements for organizations and individuals planning to enter the fertilizer business. However, people preparing to open a dealership still need to learn the current regulations and prepare the necessary conditions for stable, long-term operation.

What should people opening a fertilizer dealership from 2027 keep in mind?

Although the fertilizer trading conditions in Article 42 have been cut, people preparing to open a dealership still need to complete business registration procedures and related legal obligations under current regulations.

In particular, it is important to distinguish between the repeal of the sector-specific fertilizer trading conditions and the general requirements for doing business. Understanding the scope of the changes helps traders prepare properly, avoiding procedures that have been cut and not missing obligations that still apply.

5.2. Choose a clear and reliable fertilizer supplier

Besides learning the legal procedures, choosing a supplier is one of the most important factors when starting a fertilizer business. People preparing to open a dealership should give priority to working with reputable manufacturers and distributors that have a stable supply and a product range suited to local farming needs.

In addition, carefully review the dealer partnership policies, purchase prices, payment methods, supply capacity and technical and sales support programs. These factors help traders plan their purchasing, manage capital and develop their business over the long term.

5.3. Prepare a business plan suited to the market

To run a fertilizer dealership effectively, traders should consider factors such as store location, local farmers' demand for fertilizer, investment capital, product range and how goods will be managed.

Understanding local crops, growing seasons and nutrient needs also helps dealers choose suitable products and avoid unbalanced purchasing or long-term overstock.

6. What should agricultural supply stores selling both fertilizers and pesticides note?

Agricultural supply stores that sell both fertilizers and plant protection products (pesticides) should note that the repeal of the fertilizer trading conditions in Article 42 of the Law on Crop Production does not mean that the business conditions for pesticides are repealed.

Under Law No. 21/2026/QH16, the fertilizer trading conditions in Article 42 of the Law on Crop Production are repealed. Meanwhile, the trading of plant protection products remains governed by the Law on Plant Protection and Quarantine and related legal documents.

Under Resolution No. 66.19/2026/NQ-CP, valid Certificates of Eligibility for Trading Plant Protection Products issued before the Resolution took effect may continue to be used, with no expiry date. However, this change in the certificate's validity period does not mean that the business conditions for plant protection products have been repealed.

Stores selling both product groups therefore need to clearly distinguish the rules that apply to each product line, to avoid confusing the repeal of the fertilizer trading conditions with the legal requirements that still apply to plant protection products.

7. How does the decision recognizing fertilizers for circulation in Vietnam change?

In addition to repealing the fertilizer trading conditions, the new rules also adjust the validity period of the Decision recognizing fertilizers for circulation in Vietnam, which directly affects companies that produce, import and distribute fertilizers.

Under the new rules, the Decision recognizing a fertilizer for circulation in Vietnam is valid for 10 years and may be renewed, with each renewal valid for 10 years. This adjustment makes it easier for companies to keep their products in circulation and to plan long-term production, imports and distribution.

For Decisions recognizing fertilizers for circulation issued before the new rules took effect, companies should check the validity period stated on the Decision and the relevant transitional provisions to determine how they apply and how to renew them.

Repealing the fertilizer trading conditions is an important change that helps simplify procedures and makes it easier for organizations and individuals to enter the fertilizer market. However, businesses still need to proactively keep up with the law, choose reputable sources of supply and ensure product quality in their operations.
